Some policies about launching board games abroad

When the domestic market is increasingly saturating with tightening industry policy, to enter overseas market, has become a consensus for many operators. After all, publishing games abroad means a wider market. A great companies should make profits in different countries, all over the world.



Of course, large market opportunities often come with very different market risks. More than 200 countries in the world, which means more than 200 different market patterns. Cultural differences, product characteristics, policies and regulations are all difficulties facing entrepreneurs. Today, we mainly talk about games of chance in overseas policy issues.



In the United States, for example, if you’re in New York and you want to play the Texas hold’em online, you need a VPN. Yes, you heard that right, you need to dial into Nevada with a VPN to play game. Why? There are more than 50 states in the USA, and each state has different laws. The laws say that online real-money Texas Hold’em is allowed in Nevada, but not in New York.



Virtual games of chance, on the other hand, are legal in the US and can be released on the Apple Store and Google Play without restrictions. For example, there are no restrictions on the games that are banned in the United States, such as Texas Hold’em Poker, Niu Niu, and Fried Golden Flower, as long as there is no cash exchange.

Then there is the issue of App stores (Google Play & App Store), unlike different app stores for different brands of mobile phones. The main thing to note here is the listing policies of two app stores.





I、Google Play’s listing Policies



  • Developers of real-money games (currently only allowed in the UK, Ireland and France) must successfully complete the application process to distribute their apps on Google Play;
  • The application must comply with all applicable laws and industry standards in each country / territory distributed;
  • The developer must have a valid license for each country / region in which the app is distributed;
  • The app must prevent users under the specified age from playing games in the App;
  • The app must prevent users from using it in countries / regions not covered by the game license provided by the developer;
  • The app is not allowed to use Google Pay services, including in-app purchase and settlement of Google Play. It needs to find third-party payment channels, and US banks cannot handle relevant funds.
  • The app must be available for free download and installation from the store;
  • The rating applied must be AO (adult only) or IARC’s grading;
  • And the application and its application details must clearly display information about rational entertainment.





II、 App Store’s listing policies



  • Games of chance and lotteries are the most regulated App categories and difficult to be managed on the App Store.
  • Specific requirements:
  • Prizes and contests must be sponsored by the app’s developer;
  • The official rules for prizes, contests and raffles must be stated in the application and it must be clearly claimed that Apple is not a sponsor and isn’t involved in games;
  • The App should not purchase game points or coins through in-App purchase items for use in real-money games of any kind;
  • No lottery tickets or raffle tickets shall be sold to users;
  • Do not transfer funds in the app;
  • Apps that offer real-money games (such as sports betting, poker, casino games, horse racing) or lotteries must obtain the necessary licenses and approvals only in the region where the App is used, and can be released. Such apps must be available free of charge in the App Store.
  • Illegal assistive tools, including markers, are not allowed on the App Store;
  • Lottery apps must have rewards, odds and prizes.





III、Advertisement in Facebook, ADWORDS etc.



FACEBOOK: FB is permitted to place ads in games of chance, but only after prior approval and in accordance with the laws of the regions where the ads are placed. The application form requires you to fill in your personal advertising account and contact information, as well as the region where you are placed ads, after approval, you can promote game ads, but subject to local laws and policies.



ADWORDS: Google’s advertising policies are relatively lenient. For example, it does not require prior approval to promote offline gambling ads in the United States, such as casino ads in Las Vegas. However, if it is an online advertisement, it must be verified by Google, just like FB policy.





IV、Conclusion



Real-money games of chance are not currently available on Google Play or Apple’s App Store (except in a few countries). But a number of criminals have exploited loopholes in these Application stores to release plenty of real-money games. In general, the policies are different in each country with relevant ways of operation. Operating board and card games overseas must comply with local laws, regulations and customs, so as to remain invincible.
